Understanding the History of Custody CasesThe "Tender Years Doctrine" is an old legal doctrine stating that young children should be cared for by their mother while the father earns a paycheck. Although the California Family Code states that custody is gender neutral, the precedent set by the Tender Years Doctrine has been tough to overcome. Though we have made great strides in gender equality in the many years since the Tender Years Doctrine was first applied, the practical reality is that custody is not gender neutral. This burden, however, is slowly beginning to change. I advocate for fathers under the presumption that the father should be awarded an equal 50-50 split in custody and visitation, unless one of the parties acts in way that is not in the best interest of the child.
